Abstract
The author explores the concept of matrimonial property rights in order to move beyond the lack of economic value attached to a woman’s contribution to the household. The author evaluates the conceptual basis of the right to matrimonial property by considering the prevalent social understanding of sexual division of labour. The author also looks at the personal laws regimes under Hindu, Muslim and Christian law, also along with the provisions for maintenance in the Code of Criminal Procedure, and argues that the limited property rights of Indian women must be improved to adequately compensate women for their unpaid domestic labour.
