Abstract

The author writes this piece in the context of the use of the American concept of "environmental negotiation and mediation" has been proposed by legal scholars for different areas of German environmental law. The author argues that the West German legal scheme allows for the possibility of expanding the use of negotiation and providing for mediation. The author recommends limited experimentation to gain experience before an overhaul reform is undertaken. (Editor’s abstract.)
