Abstract
This paper first provides an overview of "Special 301", next looks at how the provisions have been applied worldwide, and then focuses on the operation of "Special 301" in India, one of the countries singled out for alleged intellectual property abuses under the new legislation. The author argues that on the face of it, the "Special 301" provisions seem to have a legitimate purpose. However, reasonable that position may seem, it cannot be justified from an international standpoint. (Editor’s abstract.)
