Abstract
The author recounts struggles and cases that show the vicissitudes and difficulty with which the great rights and liberties were won. This exploration is underpinned by the principle of independence of the judiciary, supplemented by a comparative of the American and the English experience. The cases Divan looks at pertain to personal liberty, fundamental rights and the judiciary and the emergency. The focus on the Keshavnanda Bharati case is undertaken by Divan to act as both a warning and a beacon to both lawyers and citizens, arguing for the need for eternal vigilance to guard fundamental rights.
