Abstract

This commentary critiques the Supreme Court of India's 2026 report, Judgments and Gender, which mandates sensitive judicial language to replace terms like "concubine" or "mistress" with neutral labels like "partner". The author argues that while sanitizing vocabulary restores human dignity, it creates a severe operational gap in family law. In statutes like HAMA and the PWDVA, these retired words function as precise legal definitions required to establish causes of action, determine maintenance, or classify non-marital relationships. By flattening these thresholds into broad descriptions, the judiciary prioritizes vocabulary over the substantive rules governing litigant relief. True reform must address statutory criteria rather than mere euphemisms
