Abstract

This article analyses the establishment of the ASEAN Economic Community (AEC) from a legal perspective by scrutinising the ASEAN Agreement on Trade in Goods (ATIGA). It first contextualises the ATIGA Agreement by providing a brief overview of the AEC and legal instruments concluded before the ATIGA Agreement such as the ASEAN (Bangkok) Declaration, the ASEAN Charter and the creation of ASEAN Free Trade Area in 1992. It then identifies principles and features which form a bedrock of the ATIGA Agreement and highlights Indonesia’s implementation of the same. The article ends with a few concluding remarks regarding the ATIGA Agreement, its legal nature and its contextual significance.
