Abstract

This policy submission by the Centre for Health Law, Policy and Ethics (CHLPE), NLSIU provides a structural critique of India’s Draft National Health Research Policy, 2026, focusing on resolving its omission of crucial statutory cross-references, its lack of clear appeal mechanisms, and its conflicts with existing legal rules. CHLPE points out regulatory overlaps within the proposed research ecosystem, noting direct friction between the single-ethics review proposal and geographic constraints under the New Drugs and Clinical Trials Rules, 2019, alongside unaligned data privacy rules under the DPDP Act, 2023. Furthermore, the submission demands broader definitions for vulnerable populations to match ICMR guidelines, highlights unresolved statutory benefit-sharing mechanisms under the Biological Diversity Act, and calls for a harmonized interface between the pricing powers of the National Pharmaceutical Pricing Authority (NPPA) and health technology assessment frameworks to ensure equitable public benefit.
