Abstract

The debate on the protection of intellectual property rights (IPs) assumed much momentum in India in the context of the TRIPs Agreement (Trade Related Aspects of Intellectual Property Rights)under the GATT Final Act. From the very inception of the TRIPs provisions for the Uruguay Round of GATT negotiations, developing countries including India raised serious objections. The major apprehension was regarding the impact of a uniform standard of IPR protection on industrial and technological development of weaker nations.' When the negotiations concluded and the WTO came into existence, it was realized that the Agreement on TRIPs would be the key instrument through which the stronger nations would be able to control the economic development of weaker nations. Since India has joined as a member of WTO, accepted the GATT Final Act and started introducing amendments to the existing intellectual property laws, it is important to take a look at various issues and the possible impact of the TRIPs Agreement on India's economic development.
